A buddy of mine called me yesterday and was asking me about a non-compete agreement that his employer was making mandatory after he had already worked for them for more than a year.
The agreement, which he forwarded to me, was pretty ridiculous even for a non-compete, but my question is whether or not it’s kosher to implement something like this with people that are already on your staff? The most glaring portion revolved around new business prospects, and stated that if a name was on their (his agency’s) prospect list, then said employee could not work for them, approach them, or work with an agency that approaches them.
Now, I know these things are almost impossible to enforce, but when you have a wife and kids and are up against it with an agency that has an army of attorneys, it’s probably pretty scary. That, paired with the fact that if he didn’t sign the agreement he would be terminated, seemed pretty rough to yours truly.
I would love to get some comments on this.
